Rakib (Allowed) CRM (A) 1768 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baishnabnagar Police Station case no. 1676 of 2025 dated 24.12.2025 under Sections 111(2)/111(4)/317(2)/317(4) of the Bharatiya Nyaya Sanhita, 2023 read with Section 11 of the Prevention of Cruelty to Animals Act, 1960. And In the matter of : Manirul Seikh @ Monirul Sk @ Manirul Sk ……Petitioner. Mr. Md. Wasim Akram Ms. Sabrina Parveen .....for the Petitioner. Mr. Krishnendu Bhattacharyaa, Ld. APP Mr. Bankim Pal ……for the State. Learned advocate appearing for the petitioner submits that similarly placed accused person has been granted anticipatory bail in CRM (A) 1314 of 2026. Learned advocate appearing for the State opposes the prayer for anticipatory bail. However, having regard to the locus of the present petitioner with the other accused person who has been granted bail in CRM (A) 1314 of 2026, I am inclined to extend the same relief to the present petitioner. Accordingly, prayer for anticipatory bail of the petitioner namely, Manirul Seikh @ Monirul Sk @ Manirul Sk is allowed. As such, in the event of arrest, the petitioner shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the 2 conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since, charge-sheet has already been submitted before the jurisdictional Court this order of anticipatory bail of petitioner shall remain in force for a period of six weeks from date. With the aforesaid observations, CRM (A) 1768 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
