Kausik (Allowed) CRM (A) 1775 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Barabani Police Station Case No. 60 of 2019 dated 12.06.2019 under sections 21(C)/29 of the NDPS Act. And In the matter of : Satrughana Rout ……Petitioner. Mr. Srikanta Dutta ……for the Petitioner. Mr. Krishnendu Bhattacharya, Ld. APP Ms. Priti Kar Bagchi ….for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated in the instant case on the basis of statement of co-accused and there has been no recovery from the available places with which the petitioner is associated. Learned Additional Public Prosecutor opposes the prayer for bail. The case is of the year 2019. However, there has been interference in CRR 1908 of 2026 regarding the proclamation issued. As such, since there is no seizure from the petitioner and is implicated on the basis of statement of co- accused, I am inclined to extend the benefit of anticipatory bail. As such prayer for anticipatory bail is allowed. 2 As such, I direct that in the event of arrest, the petitioner namely, Satrughana Rout be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the charge sheet has already been submitted this order of anticipatory bail will remain in force for a period of 6 weeks from date. Thus, CRM (A) 1775 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
