Tiwari, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 16/03/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 92/2025 registered at Police Station Batoda District Sawai Madhopur for the offence(s) under Sections 305(a) and 331(4) of BNS, 2023. 2. Learned counsel for the applicant has submitted that the applicant is a young man, who is sole bread earner for his family. It is also submitted that the matter is triable by Magistrate First Class. 3. Per contra, learned Public Prosecutor has submitted that though the matter is triable by Magistrate, considering 11 criminal antecedents of similar nature being registered against the applicant and the same being of recurring nature, it will be [2026:RJ-JP:11102] (2 of 2) [CRLMB-3147/2026] interest of justice that as the applicant is habitual to committing such offences, appropriate additional conditions may be imposed. 4. Heard and considered. 5. Considering the facts and circumstances, taking note of the fact that the applicant is a young man; that the matter is triable by Magistrate First Class, however, taking note of the fact that 11 criminal antecedents of similar and recurring nature are registered against the applicant, and, without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail subject to condition that accused-applicant shall contribute to the Swachh Bharat Abhiyan – initiative of the government, for a period of two months from the date of enlarging on bail, for two hours daily, as an honorary work, under the supervision and directions of the SHO concerned. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Deepak S/o Shri Ramkhiladi shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
