CRM (NDPS) 218 of 2026
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Coke Oven Police Station Case No. 81/2024 dated 31.03.2024 under Sections 21(c)/29 of the NDPS Act, 1985.
And In the matter of : Mohammad Sk. @ Kalo & Anr.
……Petitioners.
Mr. Tapodip Gupta
Mr. Suman Bhanja
……for the Petitioner.
Mr. Iqbal Kabir Ms. Sonali Bhar
……for the State.
Learned advocate appearing for the petitioner submits that the allegation against the petitioner relate to recovery of 521 Gms. of Brown Sugar from the joint possession of the petitioners.
Learned advocate for the State opposes the prayer for bail and draws the attention of the Court to the order dated 17.07.2025 passed in CRM (NDPS) 604 of 2025.
It has been submitted that there was direction for concluding the trial within a period of 10 months from the next date fixed for the case before the learned Trial Court.
2
According to the learned Advocate the said period till date is not over. Petitioner would renew his prayer for bail after the said period is over.
Needless to state prosecution is proceeding at a very slow pace in spite of the direction passed by the High Court. Only one witness has been examined out of the cited 11 witnesses.
Learned Trial Court would adhere to the earlier directions passed in CRM (NDPS) 604 of 2025.
Accordingly, CRM (NDPS) 218 of 2026 is rejected at this stage.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
