ORDER:
This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer:
“to issue writ of mandamus declaring the proceedings of the 3rd respondent dated 12-11-2019 in removing the petitioner from the post of anganwadi worker, Jaggapuram village, Gantyada mandal is illegal and arbitrary and consequently direct the respondents 2 to 5 to allow the petitioner to continue as anganwadi worker, Jaggapuram village, Gantyada mandal and set aside the proceedings of the 3rd respondent dated 12-11-2019 and pass”

The case of the petitioner is that she was appointed as anganwadi worker for Jaggapuram village, Gantyada mandal, Vijayanagaram district vide orders dated 30.08.2018 of the 3rd respondent after due selection procedure. 3. While the matter stood thus, the 5th respondent issued memo dated 21.09.2019 to the petitioner alleging that the petitioner has committed certain irregularities while performing her duty. On 28.09.2019, the 5th respondent issued another memo calling for an explanation from the petitioner for the same allegations mentioned in the earlier memo; accordingly, the petitioner submitted her explanation on 28.09.2019 without considering which, the 3rd respondent issued a show cause notice dated 21.10.2019 calling for explanation once again for which, the petitioner submitted her explanation on 25.10.2019 ventilating her

grievance. The grievance of the petitioner is that without considering the explanation submitted by the petitioner, the 3rd respondent, vide proceedings dated 12.11.2019 removed the petitioner from the post of anganwadi worker of Jaggapuram village, Gantyada mandal without assigning any reasons. Challenging the said proceedings dated 12.11.2019, the present writ petition is filed. 4. Heard Mrs. Pulipati Radhika, learned counsel for the petitioner and learned Assistant Government Pleader for Women Development and Child Welfare. 5. Perused the material available on record. The facts of the writ petition are not in dispute.
The respondent authorities, upon inspection on 10.09.2019, found the petitioner absent at Jaggapuram anganwadi centre in Guntyada mandal, as such, the petitioner was issued memos on 21.09.2019 and 28.09.2019. As the petitioner refused to take the memos, the 3rd respondent issued a show cause notice on 21.10.2019 seeking explanation from the petitioner. On 25.10.2019, the petitioner submitted her explanation as under:

On 10-09-2018 at 10.40 AM there is an allegation that aganwadi center is not open my explanation to that is on 10-09-2018 there is meeting at 1.C.D.5 office, Gatayada Mandalat 7.00 Am in morning this is informed to me by supervisor as per the orders of her I prepared myself to go there. I have given keys of aganwadi center to aganwadi helper srimathi

devupally Ramulamma at 7.30 AM. but due to some reasons on that day meeting has been cancelled so I went back to aganwadi center nearly at 9:00 AM as my responsibility there aganwadi center was locked. But I thought that aganwadi helper will be opening the aganwadi center but concerned aganwadi helper Devupalli Ramulaupamma without any Information she haven't attended. i haven't received any leave letter from her. I have Informed this issue to my supervisorv as per the orders of the supervisor we marked devupalli Ramulaupamma as absent. You can enquiry this in the attendance register of that day. After that I have breaked the lock of the aganwadi center, attended and done my duty., I buyed new lock for aganawadi center to lock it. But in reality on 10-09-2018 morning at 09:00 Am I have been doing my duty. As per the things said by supervisor at 10.40 AM the allegation that I have locked aganwadi center is false. But on that day there is no signature of supervisor but there is my signature that I attended on that day. 2. On 02.01.2019 supervisor came to aganwadi center, on that day there is 'Jannamabhumi program in my village jaggapuram. As a part of it we have conducted food festival program in it.
In that program pregnant women, mother of small children participated and also the mothers of children of preschool were participated in it. After that supervisor haven't given any memo's to me and also I signed in FCR that I was present on that day and the quantity in stocks were correct. 3. On 03.04.2019 supervisor came to jaggapuram aganwadi center, on the same day i.e. on 03.04.2019 there is a vaccination program in our village. In this program is conducted everyday first Wednesday of the month. In this program our supervisor madam also participated. Supervisor

signed in the FCR register that all the quantity is correct children were present. you can verify this info in the register but on that day my supervisor haven’t given any memo’s to me. So the allegation that I refused to take memo is false. 4. I have written all records related to the stocks and also I have written the details related to pregnant and mother of infants properly, I have also signed in eggs indendant register and also we are preparing the food as per the details mentioned in the S.N.P Memo. If needed you can verify the remarks. so the allegation that there are no signatures of the people who benefited were not there is false. 5. On 03.10.2019 when I was called to the office the CAS application in the mobile is showing weight 0 the allegation that I scolded them or used bad words is not true completely. So please verify the details that I have mentioned above, please do justice for me. If you…..”
6. A perusal of the impugned proceedings dated 12.11.2019, it can be observed that the explanation submitted by the petitioner was considered by the 3rd respondent.
It is evident from the record that the petitioner was a regular absentee and as such, the respondent authorities had initiated action against the petitioner by issuing memos on 21.09.2019 and 28.09.2019 and a show cause notice on 21.10.2019. A perusal of the explanation submitted by the petitioner pursuant to the show cause notice would go to show that the same is vague and the reasons assigned by her for her absence are baseless. As such, the 3rd respondent, vide impugned

proceedings dated 12.11.2019 removed the petitioner from the post of anganwadi worker of Jaggapuram anganwadi centre and has also issued orders transferring responsibilities to one A. Padmavathi, anganwadi worker, Nilavathi-3 anganwadi centre. As such, the contention of the petitioner that her explanation was not considered cannot be accepted. 7. It is also brought to the notice of this Court that pursuant to impugned proceedings, the said post fell vacant and one Devupalli Ravulappamma, anganwadi helper of Jaggapuram anganwadi centre was appointed by the respondent authorities pursuant to the interim orders passed by this Court in W.P.No.31308 of 2018, which was filed aggrieved by the action of the respondents in not promoting her to the post of anganwadi worker. The said writ petition was subsequently closed by this Court on 22.06.2026 as she is being continued as anganwadi worker till date. 8. In view of the same, this writ petition is dismissed. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Petition shall stand closed. _____________________
