D/L67 25.08.2026 Bpg. C.R.M. (A) 2763 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Gangarampur Police Station Case No.535 of 2026 dated 20.07.2026 under Sections 223(1)/323/317(2)/317(5)/3(5) of the Bharatiya Nyaya Sanhita, 2023 R/W Section 9/39/49(B)/50/51 of Wild Life Protection Act, 1972 ; Shanti Sarkar Versus The State of West Bengal Ms. Jenjia Rudra Ms. Sukanya Banerjee. …for the petitioner. Mr. Somnath Adhikary Ms. Madhurai Sinhas. …for the State. Petitioner is 73 years of old and she has been implicated because of recovery of certain schedule species/animals under the Wild Life Protection Act. State has raised objection. The recovery was from the house of the present petitioner. Consequently, I am not inclined to extent the benefit of anticipatory bail. However, if the petitioner appears before the jurisdictional court, learned jurisdictional court will independently consider the bail of the petitioner without being influenced by any observations made by this Court. Accordingly, CRM(A) 2763 of 2026 is dismissed. 2 Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
