Learned senior advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of accusations by her grandmother. According to the petitioner, the complaint was drafted by one of the relations. It has also been contended that there is a property dispute between the scribe of the FIR, the petitioner and his
2 brother/sister. State has produced suicidal note including the postmortem report which is available in the case diary. I have also taken into account the other materials appearing. Learned advocate for the de facto complainant opposes the prayer for anticipatory bail and submits that earlier the present complainant was also assaulted. Having regard to the overall materials including the accusations in the complaint where it has been stated by the complainant that the deceased suffered from some neurological problems as also the fact the postmortem report do not reflect any external injuries, I am of the view that the investigation of the case do not call for custodial detention of the present petitioner who is a lady. Consequently, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Juhi Mishra @ Miss Juhi Mishra shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Petitioner shall make herself available before the investigating officer of the case as and when called for. With the aforesaid observations, CRM(A) 1816 of 2026 is allowed. 3
