This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 1st Additional Court at Alipore, to dispose of the Title Suit no. 23679 of 2014, expeditiously. From the order sheet appended to this application, this Court finds that an application under Order 39 Rule 1 and 2 of the Code of Civil Procedure and a recall petition are also pending for hearing. The learned advocate appearing for the petitioners submits that 23rd September, 2026 is fixed for hearing of the aforesaid applications. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioners, this civil revisional application stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Additional Court at Alipore, to take up hearing of the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure and the recall petition on the next
2 date fixed, if the same are otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as without grating any unnecessary adjournment to either of the parties. After disposal of the aforesaid applications and any other interlocutory applications that may be pending, the learned trial judge shall make an endeavour to dispose of the Title Suit 23679 of 2014 as expeditiously as possible keeping in mind that the suit is pending from the year 2014. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities.
