Kiran ….for the petitioner Mr. Ajit Kumar Mishra, A.G.P., Mr. Gopal Krishna Sarkar, Mr. Milind Mohul Ghosh ....for the State Mr. Shibasis Chatterjee ….for the respondent nos. 20 & 21 When the matter was earlier taken up for hearing on 28th July, 2026 this Court directed the respondent 12 to file a report in the form of an affidavit detailing the steps taken towards restoration of the concerned plot of land to its original classification, subsequent to the order dated 29th August, 2024 passed in the Public Interest Litigation (in short, PIL) previously preferred by the petitioner herein. By the order dated 29th August, 2024, the said writ petition was disposed of observing inter alia that process has been initiated towards restoration of the concerned plot of land to its original classification. Today, Mr. Mishra, learned Additional Government Pleader appearing for the State authorities files a report of the respondent no.12 in the form of an affidavit. In the said report, the respondent no. 12 has stated inter alia that pursuant to the direction of this Court, the execution of restoration work was duly commenced on and from 3rd August, 2026 in presence of the police authorities. The excavation work of the said waterbody was successfully completed on 05th August, 2026 strictly in compliance of the orders dated 29th August, 2024 and 28th July, 2026. A report towards such completion of restoration work has also been communicated to the respondent no. 5 vide memo dated 05th August, 2026. A copy of the said report has also been handed over to Mr. Saha, learned advocate appearing for the petitioner. In view of the steps already taken by the respondent no. 12 and as the water body in the plot no.173, JL No.51, Mouza-Sahanagar has already been physically restored, no further interference is called for in the present PIL and the same is, accordingly, disposed of. There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the learned advocates for the parties. (Atarup Banerjee, J.)
