This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, Tenth Court at Alipore to dispose of the Matrimonial Suit No. 2606 of 2022 expeditiously. The learned advocate appearing for the petitioner submits that today is the date fixed for further cross- examination of PW-1. She further submits that the wife/opposite party has set up a counter-claim in the written statement. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submissions made by the learned advocate for the petitioner, C.O. 2663 of 2026 stands disposed of by requesting the learned Additional District Judge, Tenth Court at Alipore 24 Parganas (South) to take
2 up the further cross-examination of PW-1 and to dispose of the Matrimonial Suit No. 2606 of 2022 and the counter- claim as expeditiously as possible but preferably within a period of nine months from the next date fixed without granting any unnecessary adjournments to either of the parties provided the husband is not in default in payment of alimony pendente lite or maintenance. The time frame has been fixed keeping in mind that the suit is a matrimonial suit and is at the stage of evidence. With the above observations, C.O. 2663 of 2026 stands disposed of. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
