24.08.2026 Court No.35. D/L. 606. Kausik (Rejected) CRM (A) 2730 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tamluk Police Station Case No. 705 of 2022 dated 10.08.2022 under Sections 376(3)/506 of the Indian Penal Code and Section 6 of POCSO Act. And In the matter of : Suman Das ……Petitioner. Mr. Subhrajyoti Ghosh ……for the Petitioner. Mr. Rabi Shankar Chatterjee Mr. Sayan Chattopadhyay ….for the defacto complainant. Mr. Brajesh Jha Mr. Subrata Mukherjee ….for the State. Learned advocate appearing for the petitioner submits petitioner has been made a victim of circumstances over the issue of change of religion. Learned advocate for the defacto complainant opposes the prayer for anticipatory bail as the victim is aged about 15 years. State has produced the statement of the victim under Section 183 of the BNSS. 2 I have taken into account the specific accusation of the victim in a statement under Section 183 of the BNSS. Having considered the same, I am of the opinion that this is not a fit case for granting anticipatory bail. Accordingly, prayer for anticipatory bail in CRM (A) 2730 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
