Pundir, learned D.A.G. for the State. 3. Petitioner has raised the dispute with regard to a wall allegedly raised over the road own by P.W.D. and he wants to remove that wall by issuance of writ of mandamus to the concerned Authorities. 4. This Court vide order dated 17.04.2026 directed State counsel to get instructions in the matter. 5. Today, learned counsel for the State passed on instructions to this Court which are taken on record. 6. On the basis of the said instructions, it is submitted by learned State counsel that the land on which the wall has been raised does not belong to the P.W.D. as it is nowhere entered in the name of P.W.D. Haldwani rather it is private land owned by one Chandra Shekhar, therefore, the petitioner has got no right to maintain the writ petition in respect of the private dispute. 7. In view of the instructions made by learned State counsel this Court does not want to interfere in the matter. 8. Accordingly writ petition stands dismissed; however it is open to the petitioner to avail remedy, if any, by way of a civil suit. (Pankaj Purohit, J.) 22.04.2026 SK
