Accused Nos.5 to 7 in Crime No.107/2026 registered by the Chintamani Town Police Station, Chickballapura District, for offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 351(2), 352, 74, 324(4), 329(4), 190 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023'), are before this Court in this criminal petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, (for short ‘BNSS, 2023’) seeking regular bail. 2. Heard learned counsel appearing for the petitioners and learned HCGP appearing for the respondent-State. 3. FIR in Crime No.107/2026 was registered by Chintamani Town Police Station, for the aforesaid offences against one Karthik and others based on the first information dated 01.07.2026 received from Meghana, who is the alleged victim in the present case. During the course of investigation, the petitioners were arrested on - 4 - HC-KAR CNR: KAHC010552252026 NC: 2026:KHC:42180 CRL.P No. 12000 of 2026 02.07.2026 and remanded to judicial custody and in their remand application, they are arraigned as accused Nos.5 to 7 in the present case. The bail application of the petitioners filed before the Trial Court in Crl.Misc.No.197/2026 was dismissed on 25.07.2026. Therefore, the petitioners are before this Court. 4. Perusal of the material on record would go to show that in the first information, it is alleged that on 30.06.2026 at about 04.30 p.m., accused Nos.1 and 2 had intercepted the two wheeler of the alleged victim in which she was travelling and had misbehaved with her. Therefore, she allegedly had slapped them and informed about the said incident to her mother over phone. Subsequently, at about 08.30 p.m. on the same day, accused Nos.1 to 4 in the FIR and other persons came to the house of the first informant armed with weapons and after trespassing into the house, they allegedly abused the victim and her family members using filthy language. - 5 - HC-KAR CNR: KAHC010552252026 NC: 2026:KHC:42180 CRL.P No. 12000 of 2026 Subsequently, accused Nos.1 and 2 also assaulted the victim with weapons and other accused assaulted her with hands and also caused damaged to the property in her house. 5. The name of the petitioners, who are arraigned as accused Nos.5 to 7 is not found in the FIR. Allegation of assaulting victim with weapons is found in the first information against accused No.1. The alleged victim has suffered simple injuries as a result of the said assault. Petitioners are is in custody for the last more than one month and they do not have any criminal antecedents. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: ORDER i) The criminal petition is allowed. - 6 - HC-KAR CNR: KAHC010552252026 NC: 2026:KHC:42180 CRL.P No. 12000 of 2026 ii) The petitioners are directed to be enlarged on bail in Crime No.107/2026 registered by the Chintamani Town Police Station for offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 351(2), 352, 74, 324(4), 329(4), 190 of Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) Each of the petitioners shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 7 - HC-KAR CNR: KAHC010552252026 NC: 2026:KHC:42180 CRL.P No. 12000 of 2026 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
