However, so far as the present case is concerned, he has been implicated only on the basis of statement of a co- accused. Learned advocate for the State opposes such contention and submits that there were continuous transactions which are available and there are two local witnesses who stated regarding the complicity of the present petitioner. 2 I have taken into account the bank statements which do not reflect inter se transaction between the two accused persons regarding deposit of cash and withdrawal of case from the said account. Having regard to the facts of the case, I am of the opinion that as charge-sheet has been submitted, custodial detention of the present petitioner is not warranted. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Totan Ghosh] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has been submitted, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 2716 of 2026 is disposed of.
