In this application, the petitioner herein is aggrieved by the order dated 13.11.2025, by which the court below has issued warrant of arrest against the present petitioner and also by the order dated 7.1.2026 by which the warrant of proclamation has been issued against the present petitioner. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the court below had issued warrant of arrest and warrant of proclamation without giving any opportunity to the surety to produce the accused person before the court. He further submits that the petitioner is all along diligent in appearing the court. However, due to communication gap, he could not appear on the date fixed and his appointed advocate filed an absent petition before the court below. However, the court below did not consider petitioner’s prayer. Learned counsel for the petitioner on instruction submits that the petitioner wants to surrender before the court below and therefore, a liberty to that extent may be given to him.
2 Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous, the instant application being CRR 1257 of 2026 is hereby disposed of by giving liberty to the petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein. The impugned order dated 13.11.2025 and 7.1.2026 by which the warrant of arrest and warrant of proclamation were issued against the present petitioner, are hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
