Learned advocate appearing for the petitioner submits that the petitioner is in custody for 11 months. Petitioner is innocent and has been falsely implicated in connection with the instant case. Learned advocate appearing for the de facto complainant opposes the prayer for bail. Learned advocate appearing for the State opposes the prayer for bail and refers to the statement of an independent witness and post mortem report. Petitioner contests the issue that there is no motive available. However, in a case of direct evidence of eyewitness, 2 I am of the opinion that motive is uncalled for. Having considered the manner in which the prosecution case has portrayed so far as the mode and manner in which the life of the deceased was terminated, I am of the opinion that this is not a fit case for granting bail to the petitioner at this stage. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1300 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
