24.08.2026 Court No.35. D/L.585. Rakib (Rejected) CRM (A) 2709 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sonamukhi Police Station case no. 202 of 2026 dated 02.07.2026 under Sections 318(4)/316(2)/316(5)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Subhajeet Tewari. ……Petitioner. Mr. Arkadyuti Pahari Mr. Saurav Mallick Ms. Gargi Maity Mr. Alik Mandi .....for the Petitioner. Mr. Lokesh Sharma Mr. Rishav Kumar Thakur ……for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated as he had purchased a property and subsequently dispute arose and a settlement cheque was issued. Learned advocate appearing for the State submits that somebody else’s property was sold out in the year 2001 and subsequently in the year 2024. Petitioner was conscious because of the settlement cheque being issued. Having considered the nature of the transaction which has taken place, prima facie, I am of the view that an offence has been made out and petitioner’s involvement has surfaced. Having considered the complicity of the present petitioner, I am of the opinion that this is not a fit case for granting the relief sought for. Accordingly, prayer for anticipatory bail of the petitioner in CRM (A) 2709 of 2026 is dismissed. 2 Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
