2. Mr. Suyash Pant with Ms. Swati Verma, learned Brief Holder for the State.
3. This petition under Article 226 of Constitution of India has been filed by the petitioners with the prayer to direct respondent no.3-D.M. Haridwar to decide petitioners’ representation dated 10.02.2026 which they have filed with regard to using the land of petitioners for construction of a Bridge by the respondent-PWD.
4. After hearing learned Counsel for the parties, it transpires that it is not clear as to whether the land of petitioners has actually been utilized for construction of the bridge; for that purpose, petitioners should have moved a proper application before the Court of competent jurisdiction; and once the question that the land, if any, has been utilized for the construction of project comes out, only thereafter, proceedings for compensation can be initiated.
5. In such view of the matter and since the representation has no statutory force, therefore, the Court does not want to issue any direction regarding the same.
6. The writ petition is, accordingly, dismissed.
