The instant second interim bail application under Section 483 of BNSS has been filed on behalf of the petitioner Akash Jain, who is in custody in connection with FIR No.05/2024, registered at Police Station (S.O.G.), District Jaipur, ATS and SOG, for offences under Sections 285, 379, 411, 440, 120-B of BNS and Sections 15(1), 15(2), 15(3), 15(4) and 16 of Petroleum and Mineral Pipelines Act and Sections 3 and 4 of Explosive Substances Act. 2. Learned counsel for the petitioner submits that the petitioner's father is suffering from ailments. 3. Learned Public Prosecutor, in pursuance to the order passed by this Court, has submitted the verification report with regard to the petitioner's father being afflicted with ailments and family members who can take care of the petitioner's father. The report is annexed with the inquiry conducted by the ASI, Police Station VV Puram, Bengaluru City, which states that there is no male member who can take care of the petitioner's father, apart from the petitioner's wife and mother. The report also contains a certification issued by Sunflower Hospital, No.72, 14th Cross, Vijayanagar, Pipeline Road, Cholurpalya, Bengaluru, which states that on 06.04.2026 the patient is in ICU and is further advised to continue treatment in ICU given the critical nature of the medical condition. The medical report also mentions that the petitioner's father is admitted in the ICU for persistent accelerated hypertension. Furthermore, the earlier interim bail application of the accused petitioner was allowed on the ground of marriage of petitioner's sister and the petitioner has surrendered before the Authority as per the conditions imposed by the Court, therefore, considering the aforesaid facts, the second interim bail application of the accused-petitioner is allowed for 30 days from the date of his release. 5. Accordingly, it is directed that the petitioner- Akash Jain S/o Shri Champalal, shall be enlarged on interim bail for a period of 30 days from the date of receipt of certified copy of this order, provided he furnishes a personal bond in the sum of Rs.1,00,000/- and two sureties in the sum of Rs.50,000/- each to the satisfaction of the learned trial court. It is needless to say that after availing interim bail, the petitioner shall surrender before the concerned jail authority after completion of aforesaid period. 6. Furthermore, it is directed that in case the petitioner fails to surrender before the Jail Authorities within stipulated time, his bail bonds shall be forfeited and the proceedings for arresting the petitioner shall be initiated immediately by the trial court.
