Learned counsel for the respondents submits that this petition lies under the Protection of Women from Domestic Violence Act, 2005. Hence, the writ petition is not maintainable. Further Crl.A.No.342/2024 filed by the respondents is pending before the LXII Additional City Civil and Sessions Judge, Bengaluru. 3. Learned counsel for the petitioner seeks liberty to file a Crl. Appeal challenging the impugned order. 4. His submission is placed on record. 5. In view of the submission made by learned counsel for the petitioner and considering that the impugned order is also under challenge in Crl.A.No.342/2024 pending before the LXII Additional City Civil and Sessions Judge, Bengaluru, the present petition is not maintainable. 6. However, learned counsel for the petitioner is at liberty to file a fresh Crl. Appeal before the District Court - 4 - HC-KAR NC: 2026:KHC:19060 WP No. 7285 of 2024 to challenge the impugned order dated 24.11.2023 passed in Crl. Misc.No.72/2022. If any such Crl. appeal is filed, the same shall be considered and disposed of in accordance with law. 7. With the above observations, the petition is disposed of.
