Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has, inter alia, prayed for the following relief:- “That a writ of mandamus may kindly be issued directing the respondents to grant gratuity and leave encashment to the petitioner along with interest @ 12% per annum from the date of said dues.” 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:13353 2. Learned counsel for the petitioner submitted that the issue raised by the petitioner is no more res Integra as the same stands squarely covered by the judgment of the Hon’ble Division of this Court in CWPOA No. 6687 of 2020, titled Roop Lal Vs. State of H.P and others, decided on 19.04.2024. 3. Learned Additional Advocate General as also learned counsel for respondent No.4 submitted that as far as this fact is concerned, they cannot argue to the contrary but they submit that adjudication of the present petition, in light of the judgment passed by the Hon’ble Division Bench in Roop Lal Vs. State of H.P and others (supra), be subject to the legal rights of respondents to challenge the same. 4. In view of the stand taken by learned Additional Advocate General as well as learned Counsel for respondent No.4, this writ petition is disposed of by ordering that the directions passed by the Hon’ble Divison Bench in Roop Lal Vs. State of H.P and others (supra), shall be construed to have been passed in the present petition also and directions passed therein shall apply mutatis mutandis to this petition also, but this shall be subject to the legal rights of the respondents to 3 2026:HHC:13353 assail the judgment, so passed by Hon’ble Division Bench as well as this Court.
