ORAL ORDER In this writ petition, the petitioner is assailing the validity of the Karnataka Land Reforms (Amendment) Ordinance No. 13 of 2020 which became the Karntaka Land Reforms (Second Amendment) Act, 2020 dated 30.12.2020, Karnataka Act No. 56 of 2020, produced at Annexure-A, and has sought such other reliefs as prayed for.
2. Heard Sri. Sampat Anand Shetty, learned counsel for the petitioner and Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for the respondent-State.
3. It is submitted by the learned counsel for the petitioner that the petitioner is not challenging the validity of the amendment; however, he seeks
consideration of the writ petition, as the petitioner has

also challenged the order dated 15.12.2004, produced at Annexure-C, passed by respondent No. 2.

Taking into consideration the submission made by the learned counsel for the petitioner, and as the impugned order dated 15.12.2004 at Annexure-C has been passed ex-parte against the petitioner, and further as the proceedings were conducted under Sections 79-A and 79-B of the Karnataka Land Reforms Act, 1961, which provisions have subsequently been deleted/amended, and in view of the judgment of this Court in W.P. No.12829 of 2023,
disposed of on 01.04.2025, I am of the opinion that the writ petition deserves to be allowed.
5. Accordingly, the order dated 15.12.2004 at Annexure-C passed by respondent No. 2 and the order dated 23.10.2009 in Appeal No. 729 of 2006 at

Annexure-D passed by the Karnataka Appellate Tribunal are hereby set aside.

Since the proceedings have abated, the respondent-authorities are directed to enter the name of the petitioner in the revenue records in terms of the registered Sale Deed dated 11.08.1997, produced at Annexure-B, within an outer limit of two months from the date of receipt of a certified copy of this order. Accordingly, the writ petition is allowed.
