Mr. Chatterjee, learned advocate appearing for the petitioners submits that in spite of repeated directions passed by the learned executing court directing payment of decreetal dues to the petitioners, steps have not been taken by the opposite-parties in that regard. He submits that a direction be passed upon the learned Judge of the executing court to dispose of the execution case expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite parties or upon the learned advocate representing them before the Executing Court forthwith. In the light of the submission made by the learned advocate appearing for the petitioners, this
2 civil revision application stands disposed of by requesting the learned Additional District Judge, 3rd Court at Barasat to dispose of the LA(Ex) No. 1 of 2019 as expeditiously as possible without granting any unnecessary adjournment to either of the parties, keeping in mind the observations made by the Hon'ble Supreme Court in the case of Rahul S. Shah – Vs.- Jitendra Kumar Gandhi, reported at (2021) 6 SCC 418 and Bhoj Garg –Vs.- Goyal Education & Welfare Society & Ors., reported at 2025 INSC 329.
