Mr. Sounak Bhattacharya, Mr. Sounak Mandal, Mr. Anirban Saha Ray, Ms. Bipasha Bhattacharyya ….For the alleged contemnor. 1. The Court is apprised that the minor child could not be taken, in compliance of the order of this Court dated June 18, 2025, to meet the appellant/father at the designated venue on certain occasions due to the illness of the child. 2. Learned counsel for the alleged contemnor submits that he is equipped with the relevant medical papers to substantiate such contention. 3. However, learned counsel for the petitioner, on instruction, does not dispute such submission. Hence, we do not find any deliberate attempt on the part of the alleged contemnor to flout the order of visitation passed by this Court. The illness of the child on certain occasions definitely furnishes sufficient ground for the alleged contemnor/mother not taking the child for such visitation during the period(s) of illness. 4. Accordingly, no useful purpose would be sub- served in keeping the Rule alive. 5. Hence, CRC 6 of 2026 is discharged with the above observations. The connected contempt application, bearing CPAN 1463 of 2025, is deemed to stand disposed of accordingly. 6. Since learned counsel for the petitioner submits that the petitioner seeks further visitation during the upcoming Puja vacation, liberty is granted to the petitioner to file an appropriate application in connection with the appeal before the regular Bench for such relief, with an advance copy of such application, if filed, to the learned advocate for the respondent.
