1. Present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, for issuance of appropriate directions/order, directing respondents No.3 and 4 to get conducted fair and impartial investigation in case bearing FIR No.245 dated 11.11.2025 (Annexure P-1) registered under Sections 115(2), 351(2), 117(4), 191(3), 190, 109, 303(2) and 117(2) of bns, 2023 (Sections 109, 117(2) and 303(2) added later on), at Police Station Baghapurana, District Moga.

Learned counsel for the petitioner contended that despite registration of the FIR against the private respondents, the investigating agency, at the instance of local MLA namely Amritpal Singh Sukhanand is shielding the private respondents and is not arresting them despite the fact that they are roaming openly in the village and have been participating in village political campaigns. He further submitted that since the private respondents are not being arrested, they are openly threatening the petitioner of dire consequences as result of which petitioner and his family are GEETA RANI 2026.02.23 16:23 I attest to the accuracy and authenticity of this order/judgment Punjab & Haryana High Court at Chandigarh

4. Mr. Anup Singh, AAG, Punjab, in pursuance of advance notice, appears and contended that that the representation will be looked into by the competent authority.

Keeping in view the contention raised by learned counsel for the parties, the present petition is disposed of with a direction to respondent No.3–Senior Superintendent of Police, District Moga, to look into the averments made in the representation moved by the petitioner; complete the investigation and to take appropriate action on the representation dated 13.01.2026 (Annexure P-6) expeditiously.
