Mr. Sounak Mandal ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Junior Division), 3rd Court at Alipore, 24 Parganas (South) to dispose of the injunction application filed by the petitioner in Title Suit No. 929 of 2022 expeditiously. Mr. Mandal, learned advocate appearing for the petitioner submits that the injunction application was heard in part on 9th June, 2025 and the same is still pending. From the ordersheets appended to this application this Court finds that the regular presiding officer is not available and 8th October, 2026 is fixed for hearing of the injunction application. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite parties forthwith. 2 After the regular presiding officer joins, the learned Civil Judge (Junior Division), 3rd Court at Alipore, 24 Parganas (South) is requested to take up the hearing of the injunction application filed in Title Suit No. 929 of 2022 and dispose of the same as expeditiously as possible but preferably within a period of twelve weeks from the date fixed after the regular presiding officer joins. With the above observations, C.O. 2678 of 2026 stands disposed of. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
