Kausik (Rejected) CRM (NDPS) 208 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NDPS Case No. 12 of 2024 arising out of Jagacha Police Station Case No. 127 of 2024 dated 22.07.2024 under Sections 20(b)(ii)(C)/29 of the NDPS Act, 1985. Learned advocate appearing for the petitioner has drawn the attention of the Court to the earlier order passed in CRM (NDPS) 1573 of 2025 wherein directions were passed to renew the prayer for bail after the stage of consideration of charges are over. It has been submitted presently charges have already been framed and date has been fixed for commencing of witness action. Learned advocate for the State opposes the prayer for bail. It is seen from the records of the case that there were seizures of 43 Kgs. of Ganja. Having regard to the quantity of seizure, in this case I am not inclined to release the petitioner 2 on bail. However, the petitioner would be at liberty to renew the prayer for bail after the evidence of the seizure list witnesses are over. Accordingly, CRM (NDPS) 208 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
