Accused No.1 in Crime No.148 of 2026 registered by Yeswanthpura Police Station, Bengaluru City for the offence punishable under Section 22 of the NDPS Act, 1985 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.148 of 2026 was registered by Yeswanthpura Police Station, Bengaluru City against unknown persons, based on the first information dated 04.05.2026 received from Sri Sathish K, Police Officer attached to Yeswanthpura Police Station. During the course of investigation, petitioner was arrested on 04.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5308 of 2026 was dismissed on 16.06.2026. Perusal of the material on record would go to show that, based on the credible information received on 04.05.2026, FIR was registered against unknown persons and the raid was conducted. Thereafter, the petitioner was apprehended and from his possession contraband article allegedly 'MDMA' totally weighing 3 kg 69 grams was recovered and seized under panchanama. 5. The quantity weighing above 10 grams of MDMA is considered as commercial quantity. In the present case, contraband article seized was totally weighing 3 kg 69 grams and approximate value of the said article is said to be six crores. Investigation of the case is under progress. The involvement of other persons in the present case cannot be ruled out at this stage. The source from where such huge quantity of contraband article was supplied to the petitioner is also required to be found out and the antecedents of the petitioner is also required to be verified. According to the prosecution, contraband article was supplied to the petitioner by a Nigerian citizen. Under these circumstances, I am of the - 4 - HC-KAR CNR: KAHC010437352026 NC: 2026:KHC:42334 CRL.P No. 9288 of 2026 opinion that, at this stage, the prayer made by the petitioner for grant of regular bail cannot be entertained. 6.
