A compromise petition under Order XXIII Rule 3 of the Code of Civil Procedure signed by the parties and their respective advocates is filed. 3. Contents of the compromise petition are read over to the parties. They agree that the terms of the compromise petition depict true terms of settlement. They also unequivocally submit that there is no force, undue influence or coercion in reaching out terms of the compromise. 4. As such, there is no impediment for this Court to dispose of the appeal in terms of the compromise petition by answering the substantial question of law framed by the co-ordinate Bench on 20.12.2009 accordingly, in view of the settlement. 5. Accordingly, the following: ORDER i. Pursuant to the compromise petition Rs.5,00,000/- is paid today by way of Real Time - 5 - HC-KAR CNR: KAHC010313562019 NC: 2026:KHC:42399 RSA No. 1701 of 2019 Gross Settlement (RTGS) by respondents to the appellants. ii. Acceptance of compromise is subject to payment of balance amount of Rs.25,00,000/- on or before 10th November 2026 under acknowledgment. iii. After payment of aforesaid balance amount of Rs.25,00,000/- title deeds held by the legal representatives of the appellant shall be handed over to the respondents. iv.
