Accused in S.C.No.2007 of 2018 pending before the Court of XLV Additional City Civil & Sessions Judge, Bengaluru arising out of Crime No.621 of 2015 registered by K.R.Puram Police Station, Bengaluru City for offences punishable under Section 307, 504 & 509 of IPC is before this Court in this petition filed under Sections 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that, the petitioner who was earlier arrested in the present case was granted regular bail by the jurisdictional Court of Session Judge in Crl.Misc.No.26417 of 2015 vide order dated 28.12.2015. Subsequently, the case against the petitioner was committed to Sessions Court. It appears that, the petitioner was granted regular bail by the Trial Court and only for the reason that he had not appeared before Trial Court on the regular dates of hearing, coercive steps were taken against him - 3 - HC-KAR CNR: KAHC010566002026 NC: 2026:KHC:44045 CRL.P No. 12435 of 2026 and his presence was secured, and on the said date, he was remanded to judicial custody. 4. It is not in dispute that, the petitioner has no other criminal antecedents. On the merits of the case, petitioner was earlier granted regular bail and only for the reason that he had not appeared before the Trial Court on regular dates of hearing, he is now remanded to custody. For the mistake committed by the petitioner, he has been sufficiently punished. He has undertaken to cooperate with the Trial Court for the purpose of speedy disposal of the case. Under the circumstances, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.2007 of 2018 pending before the Court of XLV Additional City Civil & Sessions Judge, Bengaluru arising out of Crime No.621 of 2015 registered by K.R.Puram Police Station, Bengaluru - 4 - HC-KAR CNR: KAHC010566002026 NC: 2026:KHC:44045 CRL.P No. 12435 of 2026 City for offences punishable under Section 307, 504 & 509 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
