Vashistha, Spl.P.P. 02/ 27.01.2026: Heard learned senior counsel for the petitioner and learned counsel for the State. 2. The petitioner is apprehending his arrest in connection with Godda (M) Motiya O.P. P.s. Case No. 190 of 2025, corresponding to N.D.P.S. Case No. 15 of 2025, registered under sections 20, 27(a) and 29 of the N.D.P.S. Act, pending in the Court of learned Principal District and Sessions Judge, Godda. 3. Learned senior counsel for the petitioner submits that the name of the petitioner has come in the confessional statement and the petitioner has been implicated only on the basis of suspicion. He next submits that contraband has been recovered from another two co-accused persons and the quantity of contraband is intermediary in nature. He also submits that petitioner has got no criminal antecedent which is disclosed in para 5 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that the name of the petitioner has come in the confessional statement. 5. Considering that the name of the petitioner has come in the confessional statement, the contraband has been recovered from another ( 2026:JHHC:1936 ) two co-accused persons, the quantity of contraband is intermediary and petitioner has got no criminal antecedent which is disclosed in para 5 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Principal District and Sessions Judge, Godda, in connection with Godda (M) Motiya O.P. P.s. Case No. 190 of 2025, corresponding to N.D.P.S. Case No. 15 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
