In both the writ petitions, the petitioner has sought payment of the amounts due payable on account of the bills raised by the petitioner for the works executed by the petitioner. 2. The learned counsel appearing for the petitioner submits that the petitioner has completed all the works entrusted to him to the best satisfaction of the respondent authorities. It is submitted that the competent authority has also endorsed the progress of the work as well as the quantum of the amount payable to the petitioner in the M-books. It is further submitted that the petitioner is under severe financial stress on account of having obtained hand loans from various sources. Though the works were executed to the best satisfaction of the respondent authorities, the respondents have not released the payments. 3. The learned Standing counsel appearing for respondent Nos.2, 3 and 5 submits that an allegation was raised on the floor of the Assembly with regard to the misuse of Rs.134.00 crore allotted for the development of the Andhra Pradesh Greening and Beautification Corporation and that it was alleged that Rs.100.00 crores was paid without any actual work being completed. 4. On the said allegation, the Principal Secretary to Government, Municipal Administration and Urban Department, vide proceedings dated 18.10.2025, requested the Director General, Vigilance and Enforcement, to conduct a thorough enquiry into all the works and activities undertaken by 6 HN, J W.P.Nos.32082_2025 & 32288_2025 Andhra Pradesh Greening and Beautification Corporation during the period from 2019 to 2024 and to submit a report to the Government in a time-bound manner. It is stated in the counter affidavit that the said enquiry is still under process and, as such, the respondents pray for dismissal of the writ petitions. 5. The petitioner was entrusted with the works on 20.02.2024 and 03.10.2023 and has executed the same as required by the respondents. In the counter affidavit, it is not stated whether any amount was paid to the petitioner which would attract the allegation of receipt of payment for the works that were never executed. In such circumstances, the respondents cannot link the works executed by the petitioner to the pending enquiry and withhold the payments. 6. In reply, the learned counsel appearing for the petitioner submits that the petitioner was entrusted only with the works covered under the contracts referred to in the writ petitions and that the petitioner has never received any amounts from the respondents towards any other contract. The enquiry that is now being conducted is a comprehensive enquiry probing the works and activities undertaken by the Andhra Pradesh Greening and Beautification Corporation during the years 2019 to 2024. 7. When the respondents have not placed any material on record before this Court to substantiate their allegation that the petitioner had received amounts on an earlier occasion for works that were not executed, they cannot 7 HN, J W.P.Nos.32082_2025 & 32288_2025 be justified in withholding the amounts due payable to the petitioner under the guise of the pending enquiry. 8. Accordingly, the present writ petitions are disposed off, by directing respondent No.4 to verify and release the payments due payable to the petitioner, unmindful of the pending enquiry within a period of twelve weeks from the date of receipt of this order. No costs.
