WPA 8130 of 2026 Ramesh Mardi v.

1. It is noticed that the private respondent remained unrepresented on April 9, 2026 as well as June 9, 2026 despite service.
2. In view of repeated non-representation of the private respondent, on June 8, 2026, a Coordinate Bench of this Court had directed the petitioner as well as the WBSEDCL to serve the private respondent and file affidavit of service on the returnable date.
3. Today two affidavits of service have been filed both by the petitioner as well as the WBSEDCL which show that the postal articles have returned to the petitioner with the endorsement “No such person” in the address.
4. In such view of the matter, the Court would have to proceed in absence of the private respondent.
5. The petitioner complains of inaction on the part of the respondent WBSEDCL authorities in effecting electricity supply to the petitioner’s submersible pump. The respondent WBSEDCL authorities
submit that they are ready and willing to effect supply in favour of the petitioner but they have been prevented from doing so by the private respondent.
6. Having heard the learned advocates appearing for the petitioner and the respondent WBSEDCL authorities, this writ petition is disposed of by directing the respondent WBSEDCL authorities to effect electricity supply in favour of the petitioner within a period of three weeks from date subject to the petitioner complying with all necessary formalities.

In case, the WBSEDCL authorities meet with any resistance, the respondent WBSEDCL authorities will be free to approach the respondent no.5 being the Officer-in-charge, Bamongola Police Station seeking police assistance. In case, the said Officer- in-charge is approached by the respondent WBSEDCL authorities, the said Officer-in-charge would provide adequate police assistance to the respondent WBSEDCL authorities. Costs for such police assistance will be borne by the petitioner.
8. With the above observations, WPA 8130 of 2026 stands disposed of. There shall be no order as to costs.
9. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. 2
