This Civil Petition is filed by the petitioners/brothers for transfer of O.S.No.303/2025, from Civil Judge and JMFC at Turuvekere, Tumkur District, to the Civil Court at Nagamangala, Mandya District. 3. The said suit is filed by Respondent No.1 herein, who is the sister of the petitioners, seeking partition against her brothers. It is stated that all the brothers are residing at Nagamangala, whereas the two sisters are residing at Channarayapatna Taluk, Hassan District, which is at a distance of 56 kilometres. It is further stated that the suit properties are - 4 - HC-KAR CNR: KAHC010307102026 NC: 2026:KHC:41786 CP No. 147 of 2026 also situated within the jurisdiction of Nagamangala, Mandya District, except one item of property which is situated at Turuvekere, Tumakuru District. 4. Learned counsel for the respondents stated that the respondents are also senior citizens and it is inconvenient for them to travel all the way. 5. Admittedly, the partition suit is filed among brothers and sisters and all the members are senior citizens. Out of the 49 schedule properties, except one property, remaining properties are within the jurisdiction of Nagamangala, Mandya District. Therefore, it is convenient for both parties to examine the relevant persons from the concerned offices before the Court at Nagamangala, Mandya District. Moreover, the distance between the places is only 50 kilometres, which can be conveniently travelled by the respondents herein. Therefore, this Court finds that it is just and reasonable to transfer O.S.No.303/2025, from the Civil Judge and JMFC at Turuvekere, Tumkur District, to the Civil Court at Nagamangala, Mandya District. - 5 - HC-KAR CNR: KAHC010307102026 NC: 2026:KHC:41786 CP No. 147 of 2026 Accordingly, the Civil Petition is allowed.
