19.08.2026 Ct. No.655 Sl. No. 76 Subadip SA 61 of 2014 IA No. CAN/3/2019(Old No. 2778/2019) CAN/4/2019(Old No. 2781/2019) CAN/5/2019(Old No. 2782/2019) CAN/6/2019(Old No. 2783/2019) CAN/7/2019(Old No. 5141/2019) CAN/8/2020(Old No. 2912/2020) Nirmani Dasi & Ors. Vs. Subal Ch. Ala Ms. Kavita Rani ….for the Respondent 1. None appears on behalf of the appellants when the matter is called on for hearing. 2. Learned Advocate appearing on behalf of the respondents is present and submits that he is ready to proceed with the matter. 3. It appears from the record that yesterday, i.e. on 18.08.2026, when the matter was taken up for hearing, Mr. P.K. Yadav, learned Advocate appearing on behalf of the appellants, was present. In the presence of both the learned Advocates, the matter was taken up and the date for further hearing was fixed for today. 4. However, despite the matter having been fixed in the presence of the learned Advocate representing the appellants, none appears today on their behalf, nor is any accommodation sought. 2 5. In such circumstances, this Court finds no justification to adjourn the matter any further. The absence of representation on behalf of the appellants, despite the matter having been fixed in their presence on the previous date, indicates lack of necessary diligence in prosecuting the appeal. 6. Accordingly, the instant appeal stands dismissed for default. 7. No order as to costs. 8. Connected applications, if any, are also dismissed. 9. Let a copy of this order along with the TCR be sent down to the Trial Court immediately. 10. Interim order, if any, stands vacated. 11. Urgent Photostat certified copy of this order, if applied for, be given to the parties on payment of requisite fees. (Prasenjit Biswas, J.)
