Kaberi Dutta & Anr. …Petitioner Ms. Debamita Santra …for the Petitioner Mr. Palash Ch. Podder Ms. Anita Pandey …for the State 1. Memo of evidence submitted be kept with the record. 2. Having heard the submissions made on behalf of the learned advocate for the petitioners as well as the learned advocate for the State and on perusal of the materials in the case diary, it transpires that the petitioners are alleged to have assaulted security guard of society. 3. According to the learned advocate for the petitioner, the petitioner No. 2 is the owner of a flat in such society. There were some disputes over placing of placard. He also submits that charge- sheet has not yet been submitted. 2 4. I have gone through the materials in the case diary including the injury report. The injuries noted by the Medical Officer of the Sub- Divisional Hospital have been classified as simple. 5. Under such circumstances, considering the nature of allegations and on perusal of the case diary, the prayers for anticipatory bail of the petitioners are allowed. 6. In the event of arrest, the petitioners namely, Smt. Kaberi Dutta and Miss Anushka Dutta, shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further conditions that the petitioners shall cooperate with the investigation till submission of report in final form. 7. In the event, the petitioners fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. 8. With the aforesaid observation, C.R.M. (A) 2489 of 2026 is disposed of. 9. All parties shall act in terms of the server copy of the order downloaded from the official website of this Court. (Md.
