Petitioner, who is apprehending arrest in Crime No.89/2025 registered by Belagavi City CEN Crime Police Station, for the offences punishable under Sections 48, 49, 111, 187 and 319(2) of BNS, 2023 and Sections 66(C), 66(D) and 75 of the Information Technology Act, 2000, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.89/2025 was registered by CEN Crime Police Station, Belagavi, for the offences punishable under Sections 66(D) and 66(C) of the Information Technology Act, 2000 and Sections 187 and 319(2) of BNS, 2023, against unknown persons. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.4802/2026 before the Trial - 3 - HC-KAR CNR: KAHC010444262026 NC: 2026:KHC:42314 CRL.P No. 9507 of 2026 Court which was rejected on 05.06.2026. Therefore, he is before this Court. 4. Learned counsel for the petitioner having reiterated the grounds urged in the petition submits that petitioner has no other criminal antecedents and accused No.1 in the present case is his relative. Only based on the confession statement of accused No.1, he is now being implicated as an accused in the present case. He is ready and willing to cooperate with the police for the purpose of investigation. 5. Per contra, learned HCGP, who has opposed the petition submits that petitioner is the master mind and accused No.1 was only working as his Manager. The role of other accused persons involved in the present case needs to be verified. Accordingly, he prays to dismiss the petition. 6. Material on record would go to show that during the course of investigation, accused No.1 and some other accused persons have been arrested in the present case and accused No.1 had revealed that it is only as per the instructions of the petitioner, the crime was committed. Large number of mobile - 4 - HC-KAR CNR: KAHC010444262026 NC: 2026:KHC:42314 CRL.P No. 9507 of 2026 phones, laptops, which were used by the accused persons in the premises in question for committing the fraud has been seized in the present case. During the course of investigation, it was found that mobile phone number of the petitioner was attached to the bank account through which the fraudulent transactions were being operated. Petitioner, who is from Gujarat State appears to have visited as many as 50 times to Belagavi in the year 2025. Police have collected sufficient material to connect the petitioner to the crime in which fraud has been committed and the victims are from the country and also from abroad. Therefore, involvement of other accused persons in the present case cannot be over-ruled. Under the circumstances, custodial interrogation of the petitioner becomes very much necessary.
