Petitioner has relied upon documents to emphasize that the petitioner is an Indian. The said documents be produced before the jurisdictional court. The learned CJM, Nadia is directed to conduct an enquiry in respect of the documents relied upon by the petitioner and if a bail application is filed on satisfaction it would be the discretion of the learned CJM to consider the same in accordance with law. If the authenticity of the documents are not to the satisfaction of the learned CJM, learned CJM will call for an enquiry from an appropriate Officer concerned and thereafter decide the bail application if preferred by the petitioner. In view of the documents which have been enclosed in the application, I am of the opinion that at the first instance the same should be considered by the learned jurisdictional court. With 2 the foresaid observation, no interference is made by this Court. At this stage, the prayer for bail of the petitioner is rejected. However, learned CJM, Nadia would adhere to the directions passed above. Thus, CRM(M)1385 of 2026 is dismissed.
