1. This writ petition under Article 226 of the Constitution of India has been filed by the petitioner seeking a direction to respondent authorities to properly investigate into the matter and immediately arrest the accused persons as per registered FIR bearing Crime No.0185 of 2026 in Police Station – Nandghat, District Bemetra for the offence punishable under Section 296, 309 (4), 324 (5), 115 (2), 3 (5) of BNS.

Learned counsel for the petitioner would submit that respondent No. 5 and 6 are the Sarpanch and Up-Sarpanch of Village- Narayanpur, District Bemetara, and respondent No. 7 to 9 are their associates. On 29.07.2026 at about 8:30 p.m., the said respondents and their associates, after a
3 / 5 dispute over payment of the food bill at the petitioner’s restaurant, abused, threatened and assaulted the petitioner and his relative, damaged the restaurant property and committed theft of Rs.22,000/- cash and other articles, causing a loss of approximately Rs.5,50,000/-. Despite petitioner’s call to 112 and subsequent approach to Police Chowki Maro, no effective action was initially taken, compelling him to submit a written complaint dated 31.07.2026 to the Superintendent of Police, Bemetara. Pursuant to complaint made to Superintendent of Police, FIR No. 0185 dated 31.07.2026 was registered under Sections 296, 309(4), 324(5), 115(2) and 3(5) of the BNS against respondent Nos. 5 and 6 and their associates. He submits that despite FIR, CCTV footage and other material, the accused persons have not been arrested. Accused persons have also threatened the petitioner and his family members to withdraw the complaint, however, despite written complaints in this regard, no effective protection has been provided to the petitioner and his family members. He further submits that though the petitioner appeared before the Sub-Divisional Officer (Police) on 27.08.2026 pursuant to notice dated 18.08.2026 and his statement was recorded, the statements of other material witnesses have not been recorded and the matter is still pending, compelling the petitioner to approach this Hon’ble Court seeking appropriate directions for a fair and expeditious investigation and protection of his life and property. 3. On the other hand, learned counsel appearing for the respondent-State would submit that the allegations made by the petitioner regarding inaction on the part of the police authorities are not correct. He submits that immediately upon registration of FIR No. 0185 dated 31.07.2026, the
4 / 5 police authorities have taken all necessary and possible steps in accordance with law for apprehending the accused persons. However, the accused persons are presently absconding and, despite repeated efforts and searches conducted by the police, they have not been apprehended so far. He further submits that the investigation is in progress and the Investigating Officer is taking necessary steps to trace and arrest the accused persons. 4.
We have heard learned counsel appearing for the parties and perused the material available on record. 5. The grievance of the petitioner, in substance, is that despite registration of FIR/Crime No. 0185 of 2026 at Police Station Nandghat, District Bemetara, for the offences punishable under Sections 296, 309(4), 324(5), 115(2) and 3(5) of the BNS, the accused persons have not yet been apprehended and the investigation has not reached its conclusion. 6. Having regard to the nature of the grievance raised by the petitioner and the submissions made on behalf of the respondent-State, we deem it appropriate to dispose of the present writ petition with a direction to the concerned respondent authorities, particularly the Investigating Officer, to ensure that the investigation arising out of FIR/Crime No. 0185 of 2026, registered at Police Station Nandghat, District Bemetara, is conducted fairly, impartially, expeditiously and bring to its logical conclusion at the earliest, strictly in accordance with law. 7. It is made clear that this Court has not expressed any opinion on the merits of the allegations contained in the FIR. The investigation shall be conducted independently, fairly and strictly in accordance with law. 5 / 5
