Learned advocate for the State opposes the prayer for bail and submits that from the petitioner no.1 about Rs.35,000/- was recovered and from the petitioner no.2 not only about Rs. 4.78 lakh but also gold ornaments & silver were recovered. Having considered the complicity of both the petitioners, at this stage, I am inclined to release the petitioner no.1 on bail who is similarly placed as the other 2 accused persons who have been granted bail in CRM(M) 2135 of 2025. So far as the petitioner no.2 is concerned, his prayer for bail is rejected. Hence, the prayer for bail of the petitioner no.1 is Allowed. Accordingly, the petitioner no.1 viz, Md Samiruddin @ Mahammad Samiruddin Momin shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Jangipur, Murshidabad. If on bail, the petitioner no.1 shall also make himself physically available on each and every date so fixed by the learned ACJM, Jangipur and shall not leave the district of Murshidabad without prior permission of the learned ACJM, Jangipur. Accordingly, CRM(M) 121 of 2026 is partly allowed. Pending application(s), if any, is also disposed of.
