AMBEDKAR KONASEEMA DISTRICT.533217 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or orders or direction or a writ, more particularly one in the nature of a Writ of Mandamus Declaring the actions of the Respondents, particularly Respondent Nos. 3, 4 and 5, in constantly interfering with, disrupting, and physically preventing the Petitioners from executing digging and excavation operations for the formation of freshwater fish/finfish tanks in their absolute possession and owned lands situated at Godilanka Village, Allavaram Mandal, Dr. B.R. Ambedkar Konaseema District, despite holding valid and subsisting statutory licenses issued under Form 12 of the AP State Aquaculture Development Authority Rules, 2020, as highly illegal, arbitrary, unconstitutional, a colorable exercise of power, and directly violative of Articles 14, 19(1)(g), and 21 of the Constitution of India and consequently, direct the Respondents, to not to interfere with the petitioners other wise than on due process of law and desist from causing any manner of hindrance, interference, or obstruction to the Petitioners' lawful digging and aquaculture operations and to pass. IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents particularly respondents No, 3,4, and 5 not to interfere with or obstruct the digging and excavation operations of the fish finfish tanks being carried out by the petitioners in their lands situated at Godikinds Village allavaram Mandal, Dr. B.R. Ambedkar Konaseema District pursuant to the valid Licenses issued under Form 12 of the AP stat Aquaculture Development Authority Rules 2020, and pass Counsel for the Petitioner(S): 1. GP FOR FISHERIES The Court made the following: ORDER:- Learned counsel for the petitioners submits that the petitioners have obtained the requisite license from the competent authority for conducting Aquaculture Farm. The competent authority had granted license which is valid till 28.04.2031. It is submitted that the respondent authority on the pretext of receiving a complaint from a third party on interfering with the Aquaculture activity of the petitioners. 2. Learned Assistant Government Pleader appearing for the respondents submits that the Fisheries Development Officer received a complaint from the villagers pertaining to the Aquaculture Farm of the petitioners. It is further submitted that the 3rd respondent has submitted written instructions to the learned Assistant Government Pleader duly informing that the competent authority has conducted an enquiry into the complaint received and found that there was no merit in the complaint. It is also submitted that the respondent authorities are not interfering with the Aquaculture business of the petitioners. 3. Recording the same, the Writ Petition is disposed off, making it clear to the respondents not to interfere with the Aquaculture and agricultural activities of the petitioners without following the due process of law. There shall be no order as to costs.
