1. The petitioners are unrepresented today; they, by the present criminal revisional application, have prayed for quashing and/or stay of all proceedings of the Complaint Case No. CS/31771/2021 on the ground that being non-Executive Directors of the M/s. Leading Hotels Limited, and not being signatories to the dishonoured cheque in question, cognizance of the alleged offences against them under Section 141 of the Negotiable Instruments Act, 1881 could not have been taken by the 3rd Court of Learned Metropolitan Magistrate, Calcutta.
2. The learned Counsel for the State, by the order dated August 05, 2026, was directed to file a progress report of the proceedings of the said Complaint Case by the adjourned date.
3. Mr. P. Karan Singh, learned counsel for the State, complying with the said direction, files such report, which is kept with the record.
4. On perusal of the said progress report, it appears that the Learned Metropolitan Magistrate by the order dated 23rd April, 2025 has disposed of the aforesaid Complaint Case.
5. The connected proceeding initiated by the said Complaint Case being the subject matter of challenge in the present revisional application has already been disposed of, consequently, the
2 reliefs prayed for by the petitioners in the present revisional application, have now become infructuous, as such the criminal revisional application has no legs to stand on and is liable to be dismissed.
6. Accordingly, CRR 4382 of 2022 is dismissed as infructuous.
7. There shall be no order as to costs.
8. Interim order, if any, stands vacated.
9. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
