Mr. Parmanand Sharma, APP, Ms. Tanusree Kar ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for eight months. Petitioner was at the place of occurrence where the offence took place, but the vital blow was inflicted by one Ashadullah. So far as the petitioner is concerned, the accusation against the petitioner was that he inflicted fists and blows. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the deceased prior to his death before the investigating officer of the case. There are statements of independent witnesses. All the statements are in the same tune. I have taken into account the background of the case which relates to a problem of neighbours and a young boy 2 and girl of each family in a relationship. Having considered the background of the case which resulted in the present dispute and the role of the present petitioner, I am of opinion that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Mohammad Sahabuddin @ Sahabuddin shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chanchal. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Trial Court. The application for bail, being CRM (M) 1299 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
