In this application, the petitioner herein is aggrieved by the order dated 1.12.2022, by which the court below had issued warrant of arrest against the present petitioner. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that the impugned order suffers from illegalities and infirmities and as such, it does not merit any
consideration whatsoever. However, learned counsel for the petitioner on instruction made an innocuous prayer that he may be given liberty so that he may surrender before the court below within a fortnight. Having heard learned counsel for the petitioner and the State, I find that the prayer made by the petitioner is innocuous and therefore, it can be allowed. Accordingly, the instant application being CRR 1645 of 2025 is hereby disposed of by giving liberty to the petitioner to surrender before the court below within a fortnight from this date and in the event of such surrender, the court below will
2 dispose of his prayer in accordance with law without being influenced by any observations made herein. The impugned
order dated 1.12.2022 and the subsequent orders, which pertains to the issuance of warrant of arrest against the present petitioner, are hereby stayed for a fortnight or till the petitioner surrenders before the court below, whichever is earlier. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
