Mr. Lalratan Mondal …for the petitioner By the order impugned, the application under section 151 of the Code of Civil Procedure filed by the petitioner was rejected and the hearing of the application for temporary injunction has been fixed. After going through the impugned order, this Court finds that after the ad interim injunction was refused and the defendant no.2 was added as a party, an application under section 151 of the Code of Civil Procedure was filed praying for an order of injunction. Such application stood rejected by the impugned order. Though the application was styled as one under section 151 of the Code of Civil Procedure but the same is in form and substance an application for injunction. An order rejecting the prayer for injunction is an appealable one. For such reason, this Court is not inclined to entertain this civil revision application insofar as the challenge thrown against the order refusing the prayer for injunction. The petitioner will be at liberty to take steps in accordance with law before the appropriate forum. At this stage, the learned advocate for the petitioner submits that a direction be passed upon the learned trial judge to dispose of the pending application for injunction 2 expeditiously. The learned Civil Judge (Junior Division), Kalyani, Nadia is requested to take up the hearing of the injunction application on the next date fixed and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. With the above observation, this civil revisional application stands disposed of.
