COMMON ORDER:
W.P.No.25109 of 2021 is filed seeking to set aside the impugned proceedings issued by the 2nd respondent vide H.O.Ref.No.PD/Disc.Cases/Eluru dn./2018/1952 dated 11.07.2020, O/O.No.48/2020, ordering for a second enquiry pursuant to the charge memo issued by the 2nd respondent vide Ref.No.PD/D.C/K.S.S.N.R/2018/548, dated 29.05.2018. 2. While the said writ petition is pending for consideration, it appears that the 2nd respondent has passed an order for recovery of an amount of Rs.12,33,765/-, on the basis of re-enquiry under Regulations No.22 vide Office Order No.93/2021 issued by the 2nd respondent in Ref.No.PD/DC/KSSNR/2018/1078 dated 28.12.2021. Challenging the same, W.P.No.14338 of 2022 has been filed. 3. Literally, W.P.No.25109 of 2021 has rendered infructuous. Therefore, W.P.No.25109 of 2021 is dismissed as infructuous. 4. Now, learned counsel for the petitioner requested this Court to permit the petitioner to avail alternative remedy against the order in Ref.No.PD/DC/KSSNR/2018/1078, dated 28.12.2021. 5. In view of the said submission, the Writ Petition No.14338 of 2022 is dismissed granting liberty to the petitioner to avail alternative remedy against the order No.93/2021, issued by the 2nd respondent, in
5 Ref.No.PD/DC/KSSNR/2018/1078 dated 28.12.2021. The petitioner is permitted to avail alternative remedy within a period of three weeks from the date of receipt of a copy of this order. On availing such remedy, the respondents are directed to dispose of the same, in accordance with law and expeditiously as possible. There shall be no order as to costs.
