ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.100 of 2026 registered for the offences punishable under Section 106 of BNS, 2023. 2. Lethif, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the affidavit. Terms of settlement reads as follows:
"AFFIDAVIT
We, (1) Sri. NAGABHUSHAN N, S/o. Narayana Chari K, Aged about 37 years, Residing at: Dandiganahalli, Vijayapura District, Bengaluru Rural, Bengaluru-562 132, (2) Sri. PRATAPA, S/o. Sudhanama, Aged about 33 years, Residing at: Gangavathi Road, Naresha Complex, Saranabasaveshvar Nagar, Sidhanaur, Raichur District- 584 128, now today at Bengaluru, do hereby solemnly affirm and state on oath as follows:
1. We state that, we are aware about the filing of the above proceedings. We know the facts and circumstances of the case. Hence, we are swearing to this affidavit. 2. We state that, Respondent No.2/Complainant has filed a complaint against the Petitioners before By Hebbal Police Station in Crime No.100/2026 which is pending before the 8th Additional Chief Metropolitan Magistrate Court Bengaluru at Bengaluru. 3. We state that, we have compromised the above matter amicably with the Respondent No.2/Complainant by entering into MOU cum Full and Final Settlement Deed dated 23.05.2026. A copy of the MoU dated 23.05.2026 is herewith produced along with this Affidavit. - 4 -

4. We state that, the Petitioners has totally paid Rs.12,50,000/-(Twelve Lakhs Fifty Thousand Rupees to Respondent No.2 and to his family members by way of online transfer and cheques in the following manner. a. The Petitioners has paid Rs,2,50,000/-(Two Lakhs Fifty Thousand Rupees) via phonepe to the mother of the Deceased namely Bhagyamma, wife of the complainant. b. The Petitioners has paid Rs.5,00,000/-(Five Lakhs Ruppes) to the mother of the deceased namely Bhagyamma through cheque bearing No.293441 dated 06.08.2026 drawn on state bank of India, Sahakara Nagar Branch Bengaluru.
c. The Petitioners has paid Rs.5,00,000/-(Five Lakhs Rupees) to the mother of the deceased namely Bhagyamma through cheque bearing No.293441 dated 06.08.2026 drawn on state bank India, Sahakara Nagar Branch of Bengaluru
5. We further states that, Petitioners have paid the above said sum as full and final settlement to the Respondent No.2 and to his family members. In view of the settlement the Respondent No.2/Complainant have agreed to withdraw the above case against the Petitioners. 6. We state that, we have entered into above compromise and settled our dispute once for all. Hence, we may be permitted to compound the above offences as mentioned in the FIR No.100/2026 pending before the 8th A.C.M.M at Bengaluru, Court for the offence punishable under sections 106 of BNS, 2023 may be quashed accordingly. 7. We, the deponent above named do hereby declare that what is stated above is true and correct to the best of our knowledge, information and belief and this is our name and signature."

We, (1) Sri. BHEEMAPPA, S/o. Sanna Basappa, Aged about 58 years, Residing at: No.148, Harijana Oni, Sree Obaleshwara Devastanada Hattira, Lokkikere Village, Bellary-583 218, (2) Smt. Bhagyamma, W/o Bheemappa, Aged about 56 years, R/at.No.148, Harijana Oni, Sree Obaleshwara Devastanada Hattira, Lokkikere Village, Bellary-583 218, now today at Bengaluru, do hereby solemnly affirm and state on oath as follows:-
1. We state that we are aware about the filing of the above proceedings. We know the facts and circumstances of the case. Hence, we are swearing to this affidavit. 2. We state that, Respondent No.2/complainant is the father of the deceased M.B. Subhash and other deponent is the mother of the said deceased and wife of the Respondent No.2/complainant. 3. We state that, Respondent No.2/Complainant has filed a complaint against the Petitioners before By Hebbal Police Station in Crime No.100/2026 which is pending before the 8th Additional Chief Metropolitan Magistrate Court Bengaluru at Bengaluru. 4.

The Petitioners has paid Rs.5,00,000/-(Five Lakhs Ruppes) to the mother of the deceased namely Bhagyamma through cheque bearing No.293441 dated 06.08.2026 drawn on state bank of India, Sahakara Nagar Branch Bengaluru. c. The Petitioners has further paid Rs.5,00,000/- (Five Lakhs Rupees) to the mother of the deceased namely Bhagyamma through cheque bearing No.293441 dated 06.08.2026 drawn on state bank of India, Sahakara Nagar Branch Bengaluru. We acknowledge the receipts of the above payments. 6. We further states that, we have no future financial claims against each other concerning any monitory relief or any potential claims under the employee's compensation Act, Fatal Accidents Act, Law of Torts, or any other applicable civil, labour laws etc. 7. We further states that, we have withdrawn the allegations made against each other before respective courts, police station, Tribunals etc or before the statutory authority. 8. We further states that, Petitioners have paid the above said sum as full and final settlement to the Respondent No.2 and other deponent. As such, other relatives, dependents or third parties have any right to claim compensation regarding the incident dated
23.05.2026. 9. We state that, In view of the above settlement, the Respondent No.2/Complainant has no objections to withdraw the above case against the Petitioners. 10. We state that, we have entered into above compromise and settled our dispute once for all.
Hence, we may be permitted to compound the above offences as mentioned in the FIR No.100/2026 pending before the 8th A.C.M.M at Bengaluru, Court for the offence punishable under sections 106 of BNS, 2023 may be quashed accordingly. - 7 -

In the light of application for compounding being filed along with the affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER (i) Criminal Petition stands disposed. (ii) Proceedings pending in Crime No.100 of 2026 registered at Hebbal Police Station, pending on the file of the 8th Additional Chief Metropolitan Magistrate Court at Bengaluru, qua the petitioners stands quashed.
