Applicant has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) for grant of anticipatory bail as he is apprehending his arrest in connection with Crime No.483 of 2026 registered at Police Station- Kotwali, Ambikapur, District- Sarguja (CG) for offence punishable under Sections 221, 132, 126 (2) 296 (b), 351 (3), Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.09.15 12:37:04 +0530

Case of the prosecution, in brief, is that Sub Inspector of Police Station- Barora, District- Dhanbad, Jharkhand has lodged report in the concerned police station alleging that when police of Jharkhand went to Ambikapur to arrest Shabir Alam (father of applicant) and when he was intercepted, Shabir Alam started shouting the police officials and called nearby persons. Police officials were asked not to take Shabir Alam till his son Kamran Shabri (present applicant) comes. When applicant Kamran Shabri came, he provoked other persons to obstruct custody of his father and have surrounded the police officials. Taking benefit of that, Shabir Alam fled away. Incident was reported to concerned police station, based upon which, aforementioned crime was registered and applicant was apprehended in the aforementioned crime. 3. Learned counsel for the applicant would submit that the applicant has not committed any offence as alleged against him. As per allegation levelled in the FIR, it is appearing that other nearby persons have surrounded the police officials and thereafter Shabir Alam ran away. There is no involvement of applicant in commission of offence as alleged. Therefore, he may be protected by granting him benefit of anticipatory bail. -3-
4. Learned counsel for the State would oppose the submissions advanced by learned counsel for the applicant and submit that, there is specific allegation that the applicant also actively participated in commission of aforementioned crime. 5.
Upon asking learned counsel for the applicant as to reason of arrest of Shabir Alam, accused in crime registered in the State of Jharkhand, he fairly submits that according to his instructions, Shabir Alam fled away from the place, who is an accused in another crime for alleged commission of offence under Section 302 of IPC. 6. I have heard learned counsel for the parties and perused the documents available on record. 7. Considering the facts and circumstances of the case, nature of allegation levelled against the applicant, I am not inclined to extend benefit of anticipatory bail to applicant. 8.
