The petitioner has approached this Court alleging inaction on the part of the respondent CESC Authorities in effecting electricity supply at the petitioner’s business premises. 2. The respondent CESC Authorities had filed a report on August 18, 2026 when the matter was taken up last which reveals that a meter can be installed at the existing meter board of the relevant premises in favour of the petitioner subject to the petitioner complying with all necessary formalities and submitting proof of occupancy/tenancy documents and valid trade license to the electricity licensee. The report also reveals that the petitioner would be required to engage a licensed electrician to install a 2 single pole MCB at the existing meter board and the petitioner would also be required to draw electrical wires up to the shop room from the existing meter board. 3. Learned Advocate appearing for the respondent no.4 submits that he is an employee of a tenant in respect of the said premises, and he has unnecessarily been arrayed as a party respondent in the writ petition. It is submitted that the private respondent has no objection to the petitioner getting electricity supply if effecting such supply in favour of the petitioner is otherwise safe. 4. Having heard learned Advocates appearing for the respective parties and having considered the material-on-record, this writ petition is disposed of by directing the CESC Authorities to effect electricity supply in favour of the petitioner upon taking stock of the safety and security condition of the relevant premises, within a period of two weeks from the date of the petitioner complying with all necessary formalities and paying requisite charges, if any in accordance with law. 5. In case, any resistance is put up by the private respondent, the CESC Authorities 3 would be entitled to take assistance of police by approaching the Officer-in-Charge, Girish Park Police Station. In case the Officer-in- Charge, Girish Park Police Station is approached by the CESC Authorities, the said Officer-in-Charge shall afford adequate police assistance to the CESC Authorities for the purpose of enabling them to effect supply in favour of the petitioner. If any padlock is found on the meter board, the Police Authorities would be entitled to break open the padlock in case, the same is not opened by the persons in control thereof. 6. It is clarified that such padlock would be broken only if the same is on the meter board and nowhere else. 7. With the aforesaid observations, WPA 3970 of 2026 stands disposed of. No costs. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
