By the present petition, the petitioner, who is the son of the deceased employee namely Smt. Bunda Bai, seeks a direction towards the respondent authorities to grant compassionate appointment in lieu of death of his mother. Learned counsel for the petitioner would submit that while the mother of the petitioner was working as Labour under the Respondent No.2, died on 06.03.2019 in harness. Learned counsel would submit that thereafter the petitioenr moved an application dated 27.03.2019 before the Respondent No.2, but till date the same has not been considered and decided. 3. Learned Senior counsel appearing for Respondent No.2 by referring the communication dated 14.03.2024 (Annexure P-3) would submit that the RDA is examining the claim of the petitioner as per the policy / Rules of the State Government and the claim of the petitioner will be considered and decided within a period of 60 days. 4. I have heard learned counsel for the parties and perused the documents. 5. Considering the submissions made by learned counsel for the parties and, in particular, the submission made by learned Senior Counsel appearing for Respondent No.2 that the claim of the petitioner is presently under examination by the competent authority in accordance with the applicable policy/rules of the State Government and that the same shall be considered and decided within a period of 60 days, this Court is of the considered view that no further adjudication on the merits of the claim is called for at this stage. The petitioner had submitted an application dated 27.03.2019 before Respondent No.2, which is stated to be pending consideration. In view of the stand taken on behalf of Respondent No.2, the grievance of the petitioner can appropriately be addressed by directing the competent authority to take a decision on the 3 / 3 said application in accordance with law. 6. Accordingly, the instant petition is disposed of with a direction to Respondent No.2 to consider and decide the petitioner's application dated 27.03.2019, strictly in accordance with the applicable policy/rules of the State Government, by passing a reasoned and speaking order, within a period of 60 days from the date of receipt of a certified copy of this order. It is made clear that this Court has not expressed any opinion on the merits or otherwise of the claim of the petitioner, and the competent authority shall take its decision independently in accordance with law. 7.
